1. Acceptance
By using OurSparks you agree to these Terms. They form a binding agreement. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old. By creating an account you confirm you are 18+ and have legal capacity to enter a binding agreement.
3. Account
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activity under your account.
- Notify us immediately at support@oursparks.app if you suspect unauthorized access.
- One account per person. Creating multiple accounts to circumvent restrictions is prohibited.
4. The Couple Space
- Linking: Link your space with a partner via your unique SPARK code. Both parties must actively accept.
- Shared content: Content you create in the Couple Space is visible to your linked partner.
- Unlinking: Either partner may unlink at any time. Each user retains their own account.
- One partner at a time: Each account can only be linked to one partner at a time.
5. Subscription & Billing
Per-Couple Pricing
- Monthly: $4.99 USD per couple per month
- Annual: $29.99 USD per couple per year ($2.50/month — save 50%)
One subscription covers both partners. When one partner subscribes, their linked partner automatically receives full Premium access.
Partner Premium Access Ends If:
- The paying partner cancels — access ends at period end.
- The couple unlinks — non-paying partner loses access immediately.
- The paying partner deletes their account — non-paying partner loses access immediately.
Subscriptions auto-renew and are billed through Apple App Store or Google Play. Prices may change with 30 days advance notice.
6. Refunds & Cancellation
Refunds are governed by Apple and Google policies. You can cancel anytime through your subscription settings.
7. Acceptable Use
You agree not to use the Service for unlawful purposes, harass or threaten anyone, upload illegal content, reverse-engineer the app, or use automated tools.
8. Your Content
You retain ownership of all content you create. We do not use your content for advertising or AI training. You may delete your content at any time.
9. AI-Powered Features
The AI Date Planner sends your city, state, and budget to an AI provider to generate suggestions. Verify venues independently. OurSparks is not liable for AI suggestions.
10. Intellectual Property
OurSparks and all its content, features, and software are owned by OurSparks and protected by copyright and trademark law.
11. Disclaimers
OurSparks is not a mental health service or couples therapy platform. It is an app for relationship enrichment. For mental health crises please contact a qualified professional.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OURSPARKS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
13. Termination
You may delete your account via More → Privacy & Account → Delete Account. We may suspend accounts for violations of these Terms.
14. Dispute Resolution
Contact us first at support@oursparks.app. If unresolved, disputes shall be settled by binding arbitration. Class action waiver applies.
15. Governing Law
These Terms are governed by the laws of the State of Florida, United States.
16. Changes
We will update the Last Updated date and notify you at least 30 days before material changes take effect.
